Motorway Users May Get Refunds as 50% M-Tag Penalty Lands in Islamabad, High Court

Motorway users in Pakistan could receive refunds after the Islamabad High Court (IHC) took up a petition challenging the 50% extra toll charge imposed on vehicles without an M-Tag or with insufficient M-Tag balance.

The petitioner argues that the National Highway Authority (NHA) does not have the legal authority to impose the additional surcharge.

The case asks the court to declare the policy invalid and direct the NHA to refund the extra money collected from motorists.

The petition also claims the surcharge is unfair and raises constitutional concerns. It further requests that the NHA explain how drivers are notified about low M-Tag balances before any additional charges are applied.

The 50% surcharge was introduced to encourage the use of electronic toll payments and reduce delays at motorway toll plazas. The court’s decision could affect thousands of motorists who have already paid the extra fee.
